Terms of Use
These Terms of Use ("Terms") govern your use of Askive, an iPhone app that lets you build a private library of your photos, videos, audio recordings and documents and ask questions about them. Askive is published by Smbdm Marketing Services Co., L.L.C., Dubai, United Arab Emirates ("we", "us"). By creating an account or using Askive, you agree to these Terms. If you do not agree, do not use the app.
1. Apple's standard terms
If you downloaded Askive from the Apple App Store, Apple's Licensed Application End User License Agreement (standard EULA) also applies. If the two conflict, these Terms apply to the extent the EULA allows. Apple is not responsible for Askive or its content.
2. Your account
- You sign in with your email address and a one-time code. Keep access to your email secure; anyone who can read it can sign in to your account.
- You must be at least 13 years old to use Askive. If you are under the age of majority where you live, you need a parent's or guardian's permission.
- You can delete your account at any time in the app under Profile → Delete account, or by emailing us from your sign-in address.
3. Your content
- You keep all rights to the files you upload and to the questions you ask.
- You give us a limited licence to store, process and analyse your files only to provide Askive to you: making them searchable, creating summaries and transcripts, and answering your questions. We do not use your files for advertising and we do not sell them.
- You confirm that you have the right to upload each file, and that your files do not break the law or anyone else's rights (for example copyright or privacy rights).
- How we handle your data is explained in our Privacy Policy.
4. Acceptable use
Do not use Askive to upload, store or share material that is illegal, that sexually exploits children, or that you do not have the right to use. Do not try to break, overload, reverse-engineer or get around the security or storage limits of the service, or access another person's account. We may suspend or close accounts that break these rules.
5. AI answers
Askive uses artificial intelligence (Google's Gemini API) to analyse your files and answer questions. AI can make mistakes: summaries, transcripts and answers may be incomplete or wrong. Always check the cited file before relying on an answer, and do not use Askive as a substitute for professional medical, legal, financial or safety advice.
6. Storage and availability
Each account has a storage limit, shown on the Profile screen. Askive is currently free and has no in-app purchases. We work to keep the service running, but it may be interrupted for maintenance or for reasons outside our control, and features may change. Keep your own copies of important files; Askive is not a backup service.
7. Ending the service
You can stop using Askive and delete your account at any time. We may suspend or end your access if you break these Terms, or stop offering Askive. If we stop offering Askive, we will try to give you reasonable notice so you can keep copies of your files.
8. Disclaimer and liability
Askive is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. To the extent the law allows, we are not liable for any indirect or consequential loss, or for loss of data, arising from your use of Askive. Nothing in these Terms limits rights you have under consumer law that cannot be excluded.
9. Changes to these Terms
If we change these Terms we will update the date above, and for material changes we will let you know in the app. Continuing to use Askive after a change means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of the United Arab Emirates. Courts in Dubai, UAE have exclusive jurisdiction, except where consumer law requires otherwise.
